2. Permitted In-Vitro Handling & Non-Human Attestation

Purchasers unconditionally covenant that:

• The buyer will not repackage, rebrand, distribute, adulterate, or commercialize these research chemicals as consumer consumables, drugs, dietary supplements, or medical devices.

3. Regulatory Classification (Health Canada & FDA Notice)

Products featured on elementp.ca have not undergone therapeutic validation, evaluation, or regulatory authorization by Health Canada, the US Food and Drug Administration (FDA), or foreign equivalents. These materials are classified strictly as Analytical Reagents and Chemical Reference Standards.

4. Merchant Billing, Tokenized Processing & Anti-Chargeback Rules

Transactions are authenticated using end-to-end tokenized, PCI-DSS Level 1 compliant gateway architecture. By submitting payment:

• You authorize Element P to execute the verified transaction total via your designated payment instrument.
• You acknowledge that bank statement descriptors will appear as ELEMENTP or designated merchant identifiers.
• Initiating unjustified chargebacks, commercial disputes, or retrieval requests for parcels confirmed delivered via courier telemetry represents breach of contract and will result in merchant reporting and debt recovery action.

5. Indemnification & Limitation of Liability

The purchaser assumes full operational, chemical, and environmental liability for the handling, storage, and reconstitution of all received items. You agree to defend, indemnify, and hold harmless Element P, its chemists, directors, affiliates, and logistical handlers from any direct, indirect, incidental, or consequential damages resulting from chemical misuse, unauthorized handling, or statutory non-compliance.
